Welcome to RetailRush.

These Terms of Service ("Terms", "Terms of Service") govern your access to and use of the RetailRush website, online store, products, services, features and related content (collectively, the "Services").

By accessing, browsing, registering on, or purchasing from RetailRush, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our website or Services.

RetailRush is powered by Shopify, which provides the technology and infrastructure that enables us to operate our online store.

1. Eligibility and Use of the Website

By using our Services, you confirm that:

  • You are legally capable of entering into a binding agreement under applicable Indian law.

  • The information you provide to RetailRush is accurate, complete and current.

  • You will use the website only for lawful purposes.

  • You will not use the website in a way that could damage, disable, overburden or interfere with the website or its operation.

If you are a minor, you may use our Services only with the involvement and permission of your parent or legal guardian.

We reserve the right to refuse service, restrict access or cancel accounts or orders where we reasonably believe that these Terms have been violated or that fraudulent, abusive or unlawful activity has occurred.

2. Products and Product Information

We make reasonable efforts to ensure that product descriptions, images, specifications, prices and other information displayed on our website are accurate and up to date.

However:

  • Product colours may appear differently depending on your device or screen settings.

  • Product images may be for illustrative purposes and actual products may have minor differences in appearance, packaging or labelling.

  • Product dimensions, specifications and features may change where permitted by the manufacturer or supplier.

  • Product availability may change without notice.

  • We reserve the right to discontinue products or limit quantities available for purchase.

Nothing in these Terms limits any rights or remedies available to consumers under applicable Indian law.

3. Pricing

All prices displayed on RetailRush are in Indian Rupees (INR) unless otherwise stated.

Prices, discounts and promotional offers may change at any time.

The applicable price for your order will generally be the price displayed at the time you place the order, subject to correction of any genuine pricing or technical error.

Where applicable, taxes such as GST will be included in or separately identified in the price shown at checkout or in your order confirmation.

Shipping or other applicable charges, if any, will be displayed before you complete your purchase.

RetailRush reserves the right to correct pricing, product or promotional errors. If an order has been placed based on an obvious pricing or listing error, we may contact you before processing the order and provide you with the available options, including cancellation and refund where applicable.

4. Orders

When you place an order through RetailRush, you are submitting a request to purchase the products selected by you.

An order acknowledgement or confirmation does not necessarily mean that RetailRush has accepted the order for fulfilment.

We may accept, reject or cancel an order for reasons including:

  • Product availability;

  • Incorrect product or pricing information;

  • Payment failure;

  • Suspected fraud or unauthorised activity;

  • Incorrect shipping information;

  • Duplicate orders;

  • Restrictions on delivery to a particular location;

  • Violation of these Terms; or

  • Other legitimate business or operational reasons.

If we cancel an order after payment has been received, we will initiate the applicable refund through the original payment method or another appropriate method permitted by applicable law.

You are responsible for reviewing your order details, including product, quantity, price, shipping address, phone number and email address, before completing your purchase.

5. Payment

RetailRush may offer payment options such as:

  • Credit and debit cards;

  • UPI;

  • Net banking;

  • Wallets;

  • Cash on Delivery, where available; and

  • Other payment methods made available at checkout.

Payments may be processed through third-party payment service providers.

You confirm that you are authorised to use the payment method selected for your purchase.

RetailRush does not knowingly store complete payment card information on its own systems where payment processing is handled by a third-party payment provider.

If a payment fails, is reversed, charged back or is otherwise not successfully received, RetailRush may cancel or place the order on hold until payment is successfully completed.

6. Shipping and Delivery

We aim to dispatch and deliver orders within the estimated timeframe displayed on our website or communicated in your order confirmation.

Delivery timelines are estimates and may vary depending on:

  • Delivery location;

  • Product availability;

  • Courier or logistics partner;

  • Weather or natural events;

  • Public holidays;

  • Transportation disruptions;

  • Customs or regulatory requirements, where applicable; or

  • Other circumstances beyond our reasonable control.

Once your order has been handed over to the shipping or logistics partner, delivery is subject to the carrier's operational processes.

If an order is returned to us because the customer provided an incorrect address, refused delivery, was unavailable for repeated delivery attempts, or otherwise caused the failed delivery, additional shipping charges or other consequences may apply where permitted by law and our applicable shipping/return policy.

Nothing in this section limits your statutory consumer rights.

7. Returns, Refunds and Exchanges

Returns, refunds and exchanges are governed by our Refund and Return Policy, which forms part of these Terms.

Please review that policy before making a purchase.

Where applicable, RetailRush will provide return, refund or replacement remedies for products that are defective, damaged, deficient, materially different from the product advertised, or otherwise covered by applicable law or our Refund and Return Policy.

Certain products may not be eligible for return or exchange because of their nature, hygiene considerations, consumable characteristics, customisation or other legitimate reasons. Any such exclusions will be communicated in our applicable return policy or product information.

If you receive a damaged, incorrect or defective product, please contact us as soon as reasonably possible with your order details and any supporting photographs or videos requested by our customer-support team.

Approved refunds will be processed through the applicable payment method or another legally permissible method.

8. Order Cancellation

You may request cancellation of an order by contacting RetailRush as soon as possible after placing the order.

Cancellation requests are subject to the order's processing and dispatch status.

If an order has already been processed, packed or shipped, cancellation may no longer be possible and you may instead need to follow the applicable return procedure.

Where a cancellation is accepted and a payment has already been collected, the applicable refund will be processed in accordance with our Refund and Return Policy and applicable law.

RetailRush will not impose a cancellation charge on a consumer except where such charge is permitted by applicable law and our published cancellation terms.

9. Customer Accounts

Certain features may require you to create an account.

You are responsible for:

  • Keeping your login credentials confidential;

  • Providing accurate information;

  • Updating information when necessary; and

  • All activity carried out through your account, subject to applicable law.

You must notify us promptly if you believe your account has been accessed without your permission.

RetailRush reserves the right to suspend or terminate an account where there is reasonable evidence of fraud, abuse, unlawful activity or violation of these Terms.

10. Promotions and Discounts

RetailRush may offer discounts, coupons, promotional codes, sales and other promotional offers.

Each promotion may have separate terms and conditions, including eligibility, validity period, minimum order value, product restrictions and usage limits.

Unless expressly stated otherwise:

  • Promotional codes cannot be exchanged for cash.

  • Multiple promotional codes may not be combined.

  • Promotions cannot be applied retrospectively to completed orders.

  • RetailRush may withdraw or modify a promotion where permitted by law.

In the event of a conflict between these Terms and the specific terms of a promotion, the promotion's specific terms will apply to that promotion.

11. Intellectual Property

All content available through RetailRush, including but not limited to:

  • RetailRush name and logo;

  • Product and service names;

  • Website design;

  • Text;

  • Graphics;

  • Images;

  • Videos;

  • Product descriptions;

  • Icons;

  • Layouts;

  • Software;

  • Product reviews and other materials,

is owned by or licensed to RetailRush or its respective rights holders and is protected by applicable intellectual-property laws.

You may access and use the website for personal and lawful purposes.

You must not, without prior written permission:

  • Copy or reproduce substantial portions of the website;

  • Modify or create derivative works from our content;

  • Reproduce our branding or trademarks;

  • Use our content for commercial purposes;

  • Scrape or systematically extract website data; or

  • Redistribute or republish our content.

All rights not expressly granted under these Terms are reserved.

12. User Reviews, Feedback and Submissions

If you submit reviews, comments, suggestions, photographs, feedback or other content to RetailRush ("User Content"), you represent that:

  • You have the right to submit the content;

  • The content is truthful and not misleading;

  • The content does not violate the rights of another person;

  • The content does not contain unlawful, abusive, defamatory, obscene or harmful material; and

  • The content does not contain viruses, malware or other harmful code.

By submitting User Content, you grant RetailRush a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, display and distribute that content for operating, improving and promoting our Services, subject to applicable law.

We may remove or decline to publish User Content that we reasonably believe violates these Terms or applicable law.

13. Prohibited Activities

You must not use RetailRush for unlawful or fraudulent purposes.

You must not:

  • Attempt to gain unauthorised access to the website;

  • Introduce viruses, malware or harmful code;

  • Interfere with the security or functionality of the website;

  • Use automated systems to abuse or overload the website;

  • Scrape or extract website information without permission;

  • Use false identity or misleading information;

  • Conduct fraudulent transactions;

  • Attempt to obtain products through manipulation or abuse of promotions;

  • Infringe intellectual-property rights;

  • Harass or threaten RetailRush employees, representatives or other users;

  • Use the website to distribute spam or malicious content; or

  • Engage in any activity that violates applicable Indian law.

We may suspend or restrict access to the Services where reasonably necessary to protect RetailRush, our customers, payment providers, logistics partners or other parties.

These may include payment processors, logistics providers, analytics services, advertising platforms and other service providers.

Third-party services are governed by their own terms and policies.

RetailRush is not responsible for the independent operation, availability, content or policies of third-party websites or services, except to the extent required by applicable law.

15. Shopify

RetailRush uses Shopify to provide the technology and infrastructure for its online store.

Your purchase transaction is between you and RetailRush.

Shopify is not the seller of RetailRush products and is not responsible for the products sold by RetailRush, except for obligations that may apply to Shopify independently under applicable law.

16. Privacy

Your use of RetailRush is also subject to our Privacy Policy.

We may collect and process information necessary to operate our store, process orders, provide customer support, arrange delivery, prevent fraud, improve our Services and comply with legal obligations.

Personal information may be processed by RetailRush and by service providers engaged by us, including Shopify, payment processors, logistics providers and technology providers, in accordance with applicable law and our Privacy Policy.

17. Errors and Corrections

Occasionally, our website may contain typographical errors, inaccurate information or omissions relating to:

We reserve the right to correct such errors and update information where appropriate.

Where an error materially affects an order already placed, we will take reasonable steps to communicate with the customer and provide an appropriate resolution consistent with applicable law.

18. Disclaimer and Limitation of Liability

RetailRush will make reasonable efforts to keep the website available and information accurate.

However, to the extent permitted by applicable law, we do not guarantee that the website will always be uninterrupted, error-free, secure or available.

Nothing in these Terms excludes or restricts any liability or consumer right that cannot legally be excluded or restricted under Indian law.

To the maximum extent permitted by applicable law, RetailRush will not be liable for indirect, incidental, special or consequential losses arising from your use of the website or products, except where such limitation is prohibited by law.

Nothing in these Terms is intended to limit liability arising from fraud, wilful misconduct, or any other liability that cannot legally be limited or excluded.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless RetailRush and its officers, employees, contractors, service providers and affiliates from claims, losses, liabilities and reasonable expenses arising from:

  • Your violation of these Terms;

  • Your unlawful use of the Services;

  • Your violation of another person's rights; or

  • Your fraudulent or unauthorised activity.

This section does not apply to the extent that the claim results from RetailRush's own unlawful conduct or from rights that cannot legally be waived.

20. Force Majeure

RetailRush will not be responsible for delays or failure to perform obligations caused by events beyond our reasonable control, including natural disasters, floods, fires, epidemics, pandemics, war, civil unrest, strikes, government restrictions, transportation disruptions, internet or infrastructure failures, or other similar events.

Where such an event affects your order, we will take reasonable steps to notify you and provide an appropriate resolution where required.

21. Grievance Redressal

RetailRush maintains a grievance-redressal mechanism for customer complaints.

In accordance with applicable Indian e-commerce requirements, consumer complaints will be acknowledged within the applicable prescribed period and addressed within the applicable statutory timeframe. The Consumer Protection (E-Commerce) Rules, 2020 specifically provide for acknowledgement within 48 hours and redressal within one month.

22. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable consumer-protection laws and the jurisdiction of consumer commissions and other competent authorities, disputes arising from these Terms or your use of the Services shall be subject to the jurisdiction of the competent courts having jurisdiction over the place where RetailRush's principal place of business is located.

Nothing in this section limits any consumer's statutory right to approach an appropriate consumer dispute redressal commission or other authority under applicable law.

23. Changes to These Terms

RetailRush may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements or applicable regulations.

The updated Terms will be posted on this page with the revised "Last Updated" date.

Your continued use of the Services after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

24. Severability

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.

The remaining provisions will continue to remain in effect.

25. No Waiver

If RetailRush does not immediately enforce any provision of these Terms, this does not mean that RetailRush has waived its right to enforce that provision in the future.

26. Entire Agreement

These Terms, together with our Privacy Policy, Refund and Return Policy, Shipping Policy and any other policies expressly incorporated into these Terms, constitute the agreement governing your use of the RetailRush Services, subject to applicable law.
